Phase I Environmental Site Assessment Process
We help identify environmental conditions prior to entering into a contract for sale, re-financing, or option agreement, and ultimately to assist property owners to choose a site that presents manageable environmental risks.
A Phase I environmental site assessment (ESA) is a qualitative assessment intended to help owners of property satisfy one of the requirements to qualify for CERCLA's innocent landowner defense. Since the mid-1980s, it has also been incorporated into the environmental policies of most lending organizations as a requirement of any loan application involving a parcel of commercial real estate.
Our Phase One ESA reports adhere to the new American Society for Testing and Materials (ASTM) Standard E-1527-05. This new ASTM standard adheres to the new All Appropriate Inquiries Rule (AAI) set forth by the Environmental Protection Agency. This is the type of report that is required by FDIC-member banks and most other lending institutions. Even if you are paying cash for a property, we highly recommend ordering a Phase 1 report prior to purchasing a property.
A typical Phase I consists of:
A physical survey of the property and surrounding properties to assess general land use and occupants of the area;
An on-site visual inspection of the site to identify recognized environmental concerns.
A review of data regarding the local geology and hydrology;
An assessment of current and past uses and practices of the property with particular attention given to assessing if any hazardous material or waste practices have occurred at the site.
As assessment of the historic land use and development of the property through an interpretation of fire insurance maps, city directories, and/or aerial photographs of the site and interviews with persons knowledgeable of the site history;
A review of owner/operator records; and
A review of local, state, and federal regulatory agency records maintained for the site.
A written report of all findings including recommendations and conclusions.
AAI ASTM E 1527-05 COMPLIANT
- According to the new All Appropriate Inquiries or AAI Rule, only individuals with the appropriate college degree and the required work experience in environmental assessments can conduct Phase I ESA reports. If the assessor does not meet the qualifications of an Environmental Professional, then the report will be invalid and will NOT qualify the owner for the Landowner Liability Protection (LLP). LLP is one of the main reasons for conducting the Phase One report.
